1. Purpose

This Acceptable Use Policy sets out the rules for using Elvtera's website, services, systems, and any solutions we build, host, or manage for you. It exists to keep our services secure, lawful, and reliable for everyone. This policy forms part of our Terms of Service, and breaching it may lead to suspension or termination of your services.

Elvtera is operated by Collins Enterprise Solutions LLP (India) and Josh Global Brands LLC (United States).

2. Scope

This policy applies to anyone who accesses our website or uses our services, including your employees, contractors, and end users of solutions we deliver. You are responsible for making sure everyone acting on your behalf follows these rules.

3. Prohibited Activities

You agree not to use our website, services, or any solution we provide to do any of the following.

3.1 Spam

Sending unsolicited bulk messages, unauthorised marketing, or any communication that violates anti-spam laws, including through email, WhatsApp, SMS, or automated messaging systems.

3.2 Illegal Activity

Using our services for any unlawful purpose, or to promote, facilitate, or carry out any activity that breaks applicable laws or regulations.

3.3 Malware

Uploading, distributing, or transmitting viruses, worms, ransomware, spyware, or any other malicious code, or using our services to develop or spread such code.

3.4 Reverse Engineering

Reverse engineering, decompiling, disassembling, or attempting to derive the source code or underlying structure of our proprietary software, tools, or systems, except to the extent this restriction is prohibited by law.

3.5 Credential Sharing

Sharing login credentials, access keys, or accounts with unauthorised individuals, or allowing others to access services in a way that circumvents agreed usage terms or licensing.

3.6 Copyright Infringement

Uploading, using, or distributing content, data, or software that infringes the intellectual property rights of others, or instructing us to build solutions using material you do not have the rights to use.

3.7 AI Abuse

Using AI features, agents, chatbots, or voice systems we provide to generate illegal, harmful, deceptive, defamatory, or abusive content, to impersonate others without authorisation, to produce disinformation, or to circumvent the safety controls of AI providers such as OpenAI, Anthropic, and Google Gemini.

3.8 Fraud

Engaging in fraudulent activity, misrepresentation, phishing, or any scheme intended to deceive or defraud others through our services.

3.9 Security Attacks

Attempting to gain unauthorised access to systems, networks, or data, probing or scanning for vulnerabilities without permission, launching denial-of-service attacks, or otherwise interfering with the security or integrity of our infrastructure or that of third parties.

3.10 Bot Abuse

Deploying bots, scrapers, or automated processes in ways that violate the terms of the platforms involved, overload systems, or harvest data without authorisation.

3.11 Excessive API Usage

Exceeding agreed usage limits, making excessive or abusive API calls, or using integrations in a way that degrades performance for others or breaches the terms of underlying providers.

4. Your Responsibilities

You are responsible for all activity that occurs under your accounts and for the content and data you provide to us. You must keep credentials secure, use services within agreed limits, and ensure your use complies with the terms of any third-party platforms and AI providers involved in your solution.

5. Monitoring and Enforcement

We do not routinely monitor how you use our services, but we may investigate suspected violations. If we believe this policy has been breached, we may, depending on the severity, warn you, suspend affected services, remove offending content, or terminate your engagement. Where activity is unlawful, we may report it to the relevant authorities.

We will act reasonably and, where practical, give notice before taking action. In cases involving security threats, legal risk, or harm to others, we may act immediately.

6. Reporting Violations

7. Changes to This Policy

We may update this Acceptable Use Policy from time to time. Changes take effect when posted, and continued use of our services means you accept the updated policy.
